Carolyn S. Autery killed in a multi-vehicle accident in Cole County

On Thursday, July 19, Carolyn S. Autery was killed in a multi-vehicle accident at the intersection of Old Bass Road and U.S. 54 in Cole County. Ms. Autery, 64, of Lebanon, was riding as a passenger of Sharon K. Dejulio, 67, of Montrose, Colorado.

Ms. Dejulio was also injured in the incident, as was Alisha D. Burks, 36, of Tuscumbia.

The accident began at approximately 5 pm when the vehicle driven by Ms. Dejulio crossed the center line and struck Ms. Burk’s vehicle head on. Both vehicles then skidded from the road, coming to rest along the shoulder.

According to the official Missouri State Highway patrol crash report, Ms. Dejulio and Ms. Burk were both rushed to area hospitals for further observation and treatment.

Ms. Autery was pronounced deceased upon arrival at University Hospital.

It is always unfortunate when a traffic accident ends in the loss of a life. We at the law offices of Kevin J. Roach extend our sincerest condolences to the family and friends of the parties involved.

The Legal Claims

Missouri and Illinois offer a widespread system of personal injury laws meant to protect parties who are injured through another party’s negligent acts.

The party seeking relief will be entitled to compensation in the form of payment for any lost wages, pain and suffering, any damaged property, and any medical bills incurred as a result of the accident that are not a result of his or her own negligence.

Missouri law states that you have five (5) years to file your personal injury lawsuit, unlike Illinois law which allows only a two (2) year period, though you never want to wait that long to file a claim. Some cases require a good deal of discovery and preparation, so the sooner you contact an attorney to file the case, the better your odds of recovering everything you are owed will be.

There are also statutes of limitations within each state that determine how much time you have to file the wrongful death claim. In Missouri, a wrongful death claim can be filed anytime up to three years after the death of the family member.
