Should You Talk To An Attorney Before Getting Medical Treatment After An Auto Accident?

Interviewer: Should I wait to see a doctor or a physical therapist until I talk to an attorney or until the pain subsides?

Kevin Roach: No. The first and most important thing you can do initially after an accident is not call your lawyer, but go get proper treatment. If you need to go to the emergency room, do that immediately. There is time to call your attorney, but first and foremost get treatment for your injuries. Then once you're checked out by the paramedics or taken to the hospital or whatnot, at that point you need to get advised, once the dust settles a little bit, but and first and foremost get proper medical treatment.

Interviewer: What about keeping a diary or a journal of what's happened, doctors that I visit, and how it's affecting me physically on a day-to-day or weekly basis?

Kevin Roach: Journals are always very helpful to document your treatment and your pain and suffering. A lot of times, especially if there is a lapse in treatment where someone doesn’t go to the doctor, there is really no record of what they've been going through on a day-to-day basis. Journals are really good for tracking. I always encourage my clients to keep a journal, because it's always good to have record of that and that can be very powerful evidence if their cases go to trial.
